Inheriting the assets

The right of inheriting the pension assets paid to the mandatory pension fund can be realized exclusively in case of an early death of the insured person i.e. the person for which the pension funds were paid. When a fund member dies, the saved assets do not remain in the mandatory pension fund, but they are paid according to the order by government institutions!
In case of death of an insured person, the legal inheritors (the family) should initiate the proceedings for realization of the family pension (if they meet the legal requirements) or, if they are not entitled to the family pension, the family will be able to inherit the money that was paid to the mandatory pension fund. It is important to point out that the right of inheritance is realized only if the insured person did not already start to receive the pensions.
Any disposal with the assets saved in the mandatory pension fund is bound to the realization of the rights from the first pension Pillar (HZMO). Therefore, in case of death, we advise to contact the common call centre of REGOS, to the telephone number 01/ 4898- 999.
In order to assist you as much as possible in the difficult moments, we will describe in short who is entitled and what is the procedure for the realization of the pension rights in case of death of the insured person.

Obligation of ROMF in case of death of a member of the fund
If the right to the family pension exists, then, based on the Resolution by HZMO, and according to the order of REGOS, the assets from the pension account of the Raiffeisen mandatory pension fund will be transferred to the transfer account of REGOS. REGOS will proceed the money to the account of HZMO or to the account of the selected pension insurance company, from which the pension will be paid. 

If the deceased member of the pension fund was older than 55 years at the moment of death, and if he was a member of the pension fund for more than 10 years, and if, on the basis of the total capitalized assets of the deceased member of the pension fund. the monthly amount of the family pension that would belong to the members of the family according to the program of the pension insurance company, increased by the amount of the basic family pension, would amount to more than the monthly amount of the family pension, the assets will not be transferred to the account of HZMO, but they will be transferred, through the Central Registry of Insured Persons, to the pension insurance company selected by the family members, which ensures to them the monthly family pension according to its program, in accordance with the special act.
 
If the right to the family pension does not exist, the assets saved in the Raiffeisen mandatory pension fund will, according to the resolution of the competent Court, and by the order of REGOS, be transferred to the transfer account of REGOS from which they will be paid to the inheritor.

It is important to point out that, according to the legal regulations, the Raiffeisen mandatory pension fund can pay the saved assets only and exclusively to the transfer account of REGOS and according to the passed resolutions and the order of REGOS, and not directly to the inheritors.

Who is entitled to the family pension in case of death of an insured person
                          
In order to realize the right to the family pension from the first and the second pension Pillar, you must submit the request to the competent, regional service of HZMO. That is the HZMO office in the territory where the deceased person was last insured. If more than 12 months have passed since the last p payment of the contribution, then the regional service of HZMO in the territory where the residence of the person submitting the request is situated is competent. 

If death of the insured person that already started using the pension is in question, then the regional service of HZMO in whose territory the residence of the pension beneficiary was situated is competent.

You can buy the printed form for submitting the application in "Narodne novine", and, during submitting the filled-in form, the following should be enclosed:
  • the employment book of the person from which the right to the pension is derived
  • the death certificate - the marriage certificate
  • the birth certificates for all the family members that ask for the recognition of the right to the pension, and the school certificates for children in regular schooling
  • the statement whether the members of the family are employed, i.e. whether they use some other pension
If the residence of the person from which the right to the pension is derived was abroad, then the regional service where the person was last insured is competent. Along with the above documents, the proofs about the employment abroad should be enclosed (insurance cards and similar), and the proof about the citizenship.

What to do if you are not entitled to the family pension 
If there are no users of the family pensions or if that right could not be realized, the assets from the personal pension account of the deceased insured person become inheritable and are paid in cash. 

The documentation which should be submitted for payment of the inheritance to the address REGOS Gajeva 5, 10 000 Zagreb:
  1. The original or a certified photocopy of the legally valid Resolution on Inheritance in which the assets of Pillar II are stated, issued by the court/notary public in the Republic of Croatia 
  2. Request for payment of the inheritance – link na
The request for payment of the inheritance can be submitted to REGOS in a free form too, and it must contain the following elements:
  1. The name and surname of the deceased person
  2. The Unified Citizen's PIN (MBG)/Personal Identification Number (OIB) of the deceased person
  3. The name and surname of the person submitting the request
  4. The Personal Identification Number (OIB) of the person submitting the request
  5. The account of the receiver of payment in IBAN structure
  6. The date of submitting the request
  7. The request signed by own hand
The procedure of payment of the inheritance last about 15 - 20 days, if the delivered documentation is in order (mentioned above: the Resolution and the Request).
